Warranty terms & conditions

1. Overview

This warranty applies to DigiFunk radios purchased from the official DigiFunk website or from an authorised DigiFunk reseller or sales channel.

DigiFunk radios are designed to be robust, practical and suitable for demanding everyday use, including domestic use, trade use and commercial worksite environments. This warranty is provided to protect customers against genuine manufacturing faults and defects in materials or workmanship.

This warranty does not cover accidental damage, misuse, wear and tear, unauthorised modification, loss, theft, cosmetic damage, or faults caused by use outside the product instructions.

This warranty is provided in addition to your legal rights. It does not replace, reduce or limit any statutory rights you may have under UK consumer law.

Warranty claims should be submitted by email or using the contact details shown on the DigiFunk website or on your order confirmation.

3. Territorial scope

This warranty applies to eligible DigiFunk radios delivered to customers in the United Kingdom, unless DigiFunk confirms otherwise in writing.

If a product is purchased or used outside the United Kingdom, DigiFunk may still assist where possible, but warranty support, return arrangements, delivery costs and available remedies may vary depending on the location and circumstances.

4. Warranty period

New DigiFunk radios purchased from the DigiFunk website or from an authorised DigiFunk reseller are supplied with a 1-year warranty, unless a longer warranty period is confirmed in writing at the time of purchase or provided under a valid DigiFunk promotional warranty upgrade.

The warranty begins on the date you take delivery of the product. This will usually be the date shown as delivered by the courier, postal service or other delivery tracking information.

The warranty period applies to DigiFunk’s voluntary warranty only. It does not limit any statutory rights you may have under UK consumer law.

Refurbished, used, clearance or previously returned products are supplied with a 1-year warranty, unless a different warranty period is confirmed in writing at the time of purchase.

Replacement products supplied under warranty do not restart the original warranty period. They remain covered for the remainder of the original warranty period, or for 30 days from the date the replacement is delivered, whichever is longer.

5. Promotional 2-year warranty upgrade

From time to time, DigiFunk may offer a promotional extended warranty upgrade that increases the standard 1-year warranty to a 2-year warranty.

Where a valid 2-year warranty promotion applies, the extended warranty is an extension of the standard DigiFunk warranty. It covers the same manufacturer faults, defects in materials and workmanship, and failures under normal use as the standard 1-year warranty.

The 2-year promotional warranty does not provide additional cover for accidental damage, misuse, wear and tear, modification, loss, theft, cosmetic damage, water ingress beyond the IP65 rating, unauthorised repair, or any other exclusion listed in this policy.

Promotional warranty upgrades are subject to the terms stated on the relevant promotional page, product page, offer page or checkout information at the time the promotion is active.

Unless stated otherwise in the specific promotion terms:

  1. The customer must enter the required promotional code at the point of purchase.
  2. The promotional code must be valid and accepted at checkout.
  3. The promotion applies only to eligible purchases made on the official DigiFunk website at www.digifunk.co.uk.
  4. The upgrade cannot be applied retrospectively after the order has been placed.
  5. If no valid promotional code is entered at the time of purchase, the standard 1-year warranty applies.
  6. The promotion applies only to the original purchaser and the original order.
  7. Proof of purchase is required for all warranty claims.
  8. Orders placed after the promotional end date will not qualify.
  9. Warranty upgrades cannot be added after the promotional expiry date.
  10. DigiFunk may amend or withdraw a promotional warranty offer before an order is placed, but any withdrawal or change will be clearly shown before purchase and will not affect eligible orders already accepted with a valid promotional warranty upgrade.
  11. All claims under the promotional 2-year warranty are handled in line with the standard DigiFunk warranty process.

Where a promotion states wording such as “Double the protection”, “No extra cost”, “Two years peace of mind” or similar, this means the customer receives a 2-year warranty period on eligible purchases instead of the standard 1-year warranty period. The scope of cover remains the same as the standard warranty unless the promotion clearly states otherwise.

6. Eligible purchases

This warranty applies only where the product was purchased from:

  1. The official DigiFunk website.
  2. DigiFunk directly.
  3. An authorised DigiFunk reseller, marketplace seller, retailer, distributor or sales channel.

The warranty does not apply to products purchased from unauthorised sellers, private sellers, auction sites, second-hand sellers, liquidation sales, or any source where DigiFunk cannot reasonably verify the original purchase.

The warranty is available to the original purchaser only. It is not transferable if the product is sold or passed on to another person. If the radio was purchased as a gift, DigiFunk may ask for the original order details or proof of purchase before processing a warranty claim.

7. Domestic and commercial use

This warranty applies to both domestic and commercial users.

Normal trade, workplace and worksite use does not invalidate the warranty. However, the product must still be used in accordance with the operating instructions and within the limitations of the product design.

This warranty does not cover faults or damage caused by misuse, neglect, abuse, avoidable impact, improper charging, unauthorised repair, modification, or use in a way that the product was not designed to withstand.

If you purchased the product for business use, your rights may differ from consumer statutory rights. Nothing in this warranty excludes or limits any business customer rights that cannot legally be excluded or limited.

8. What the warranty covers

This warranty covers genuine manufacturing faults and defects in materials or workmanship that arise during the warranty period.

Examples of faults that may be covered include:

  1. The radio failing to power on due to an internal manufacturing fault.
  2. Charging faults caused by a defect in the radio, supplied plug or supplied charging cable.
  3. Speaker failure caused by a manufacturing defect.
  4. Display failure caused by a manufacturing defect.
  5. Button, control or port failure caused by a manufacturing defect.
  6. Battery failure caused by a manufacturing defect.
  7. Internal component failure caused by a defect in materials or workmanship.
  8. Defects in supplied accessories, including the supplied plug and supplied cable, where the issue is due to a manufacturing or supply fault.

This list is not exhaustive. Each claim will be assessed based on the information provided, the condition of the product and the nature of the fault.

9. What the warranty does not cover

This warranty does not cover:

  1. Accidental damage.
  2. Impact damage, including drops, knocks, crushing or heavy force.
  3. Misuse, neglect or abuse.
  4. Damage caused by improper storage.
  5. Damage caused by improper charging or use of unsuitable chargers, plugs, cables or power sources.
  6. Faults caused by use outside the product instructions.
  7. Water or dust damage caused by use beyond the product’s IP65 rating.
  8. Water ingress where covers, seals or ports were not properly closed, undamaged and free from debris.
  9. Damage caused by pressure washing, jet washing, submersion or prolonged immersion.
  10. Corrosion caused by exposure to chemicals, salt water, solvents or unsuitable environments.
  11. Unauthorised repairs or attempted repairs.
  12. Modifications or alterations.
  13. Removal, tampering or defacing of serial numbers, labels or identifying marks.
  14. Normal wear and tear.
  15. Natural battery ageing or gradual reduction in battery capacity over time.
  16. Cosmetic damage that does not affect operation, including scratches, dents, scuffs, fading, worn logos or general marks from normal use.
  17. Loss or theft.
  18. Damage caused in transit after delivery to the customer, unless arranged by DigiFunk as part of an approved warranty return.
  19. Damage to packaging after delivery, including torn, discarded or defaced packaging.
  20. Any fault caused by use with accessories, chargers or components not supplied or approved by DigiFunk.

10. IP65 protection

DigiFunk radios are designed with an IP65 rating.

The IP65 rating provides protection against dust and low-pressure water jets when the product is used correctly. It does not mean the radio is waterproof in all conditions.

The IP65 rating applies only when all covers, seals and ports are properly closed, undamaged and free from debris.

This warranty does not cover damage caused by:

  1. Submerging the radio in water.
  2. Leaving the radio in standing water.
  3. Pressure washing or jet washing.
  4. Using the radio with charging ports, covers or seals open.
  5. Damaged, removed, obstructed or poorly maintained seals.
  6. Exposure beyond the stated IP65 protection level.

Customers should inspect covers, seals and ports regularly and ensure they are properly closed, undamaged and free from debris before using the radio in wet, dusty or demanding environments.

11. Battery coverage

The rechargeable battery is covered against manufacturing defects during the applicable warranty period.

DigiFunk expects the battery to perform properly during the first year of normal use. Where a valid 2-year promotional warranty applies, battery manufacturing defects remain covered during the extended warranty period.

This warranty does not cover normal battery ageing, gradual reduction in battery capacity, reduced runtime caused by charging habits, storage conditions, temperature, frequency of use, or natural wear over time.

Battery-related claims may require testing, photos, videos, charging information or confirmation of the plug, cable and charging method used.

12. Supplied plug, cable, accessories and packaging

Where a DigiFunk radio is supplied with a plug or charging cable, these items are covered against manufacturing or supply defects during the applicable warranty period.

This does not cover:

  1. Damage caused by misuse.
  2. Accidental damage.
  3. Lost accessories.
  4. Damage caused by unsuitable use.
  5. Damage caused by unsuitable charging equipment or power sources.
  6. Cosmetic damage after delivery.

Issues with missing accessories, damaged packaging or delivery damage should be reported as soon as possible after delivery so that DigiFunk can investigate.

Packaging is not covered as part of the technical product warranty after delivery, except where the issue relates to a delivery, fulfilment or supply problem reported within a reasonable time.

13. How to make a warranty claim

You should contact us as soon as possible after noticing a fault. Faults must be reported within the applicable warranty period.

This reporting requirement applies to the DigiFunk warranty only and does not limit any statutory rights you may have.

When submitting a claim, please provide as much information as possible so that we can assess the issue quickly.

14. Information required for a claim

DigiFunk may ask you to provide:

  1. Your order number.
  2. Proof of purchase.
  3. The name used when placing the order.
  4. The delivery address used for the order.
  5. The date of delivery, where known.
  6. The product serial number or identifying information, where available.
  7. A written description of the fault.
  8. Clear photographs of the radio.
  9. Clear photographs of any visible damage.
  10. Video evidence showing the fault.
  11. Details of how and where the radio has been used.
  12. Details of the charger, plug or cable used.
  13. Confirmation of any promotional warranty code used at the time of purchase, where a 2-year promotional warranty is being claimed.
  14. Any other information reasonably required to assess the claim.

DigiFunk may be unable to process or approve a warranty claim if the original purchase cannot be verified or if reasonably required information is not provided.

We will not reject a claim solely because a customer cannot provide optional evidence, provided the purchase and fault can otherwise be reasonably assessed.

15. Assessment of warranty claims

Each warranty claim will be assessed based on the information provided and, where necessary, inspection of the product.

DigiFunk may ask for photographs or videos before asking for the product to be returned. In some cases, this may allow us to resolve the issue more quickly without requiring an immediate return.

If the evidence clearly shows that the product has a genuine manufacturing fault, DigiFunk may approve a repair, replacement or other appropriate remedy without requiring the product to be inspected first.

If the cause of the fault is unclear, DigiFunk may require the product to be returned for inspection and testing before a warranty decision is made.

16. Repairs and replacements

If a valid warranty claim is accepted, DigiFunk may, at its discretion:

  1. Repair the product.
  2. Replace the product with a new product.
  3. Replace the product with a professionally refurbished product.
  4. Replace the product with a fully tested used product of equivalent or better working condition.
  5. Replace the product with an equivalent or updated model if the original model is unavailable or discontinued.
  6. Provide another appropriate remedy agreed with the customer.

Any repaired, refurbished, used or replacement product supplied under this warranty will be tested before dispatch and will be suitable for normal use.

DigiFunk may use new or professionally refurbished parts when carrying out repairs, provided those parts meet appropriate performance and reliability standards.

17. Advance replacement service

In some cases, DigiFunk may provide an advance replacement before receiving the original product back.

This will usually only be considered where:

  1. The product is clearly faulty or non-operational based on photographs or video evidence.
  2. The customer has provided all required order and delivery information.
  3. The customer has provided a clear written description of the fault.
  4. DigiFunk is satisfied that the claim is likely to fall within the warranty.

Advance replacements are offered at DigiFunk’s discretion and are not guaranteed.

Where an advance replacement is provided, DigiFunk may still require the original product to be returned. If the original product is not returned when requested, or if inspection later shows that the fault was caused by damage or misuse not covered by this warranty, DigiFunk reserves the right to request return of the replacement product or seek payment for the replacement and associated shipping costs, where legally permitted.

18. Returning a product for inspection

If DigiFunk asks you to return a product for inspection, the product should be securely packed to avoid damage in transit.

Unless DigiFunk confirms otherwise in writing, the product should be returned to:

Please do not return a product without first contacting DigiFunk and receiving return instructions. This helps ensure the return is identified correctly and processed without unnecessary delay.

19. Shipping costs

This section applies where you choose to make a claim under DigiFunk’s voluntary warranty. It does not apply where you are exercising statutory rights against the seller, where different legal rules may apply.

For warranty claims, the customer is normally responsible for the cost of sending the product to DigiFunk for assessment, unless DigiFunk advises otherwise.

If the warranty claim is accepted and DigiFunk requires the product to be returned for inspection, DigiFunk will reimburse reasonable standard return postage where proof of postage cost is provided.

If the warranty claim is accepted, DigiFunk will pay the cost of sending the repaired or replacement product back to the customer using a standard delivery service.

If no manufacturing fault is found, or if the fault is found to be outside the scope of this warranty, DigiFunk may ask the customer to pay reasonable return shipping costs before the product is returned.

This shipping arrangement applies to the voluntary DigiFunk warranty process only. It does not limit any statutory rights or remedies that may apply where a consumer is exercising legal rights against the seller.

20. No fault found

If a product is returned under warranty and no fault is found, DigiFunk may return the product to the customer.

If no manufacturing fault is found, or if the issue is caused by something excluded from this warranty, DigiFunk may ask the customer to pay reasonable return shipping costs before the product is returned.

DigiFunk will only charge inspection or testing fees where those fees have been clearly notified to the customer before they are incurred.

DigiFunk will not apply such charges without first notifying the customer.

21. Warranty refusal

DigiFunk may refuse a warranty claim where there is evidence that the fault or damage was caused by something not covered by this warranty.

This may include, but is not limited to:

  1. Impact damage.
  2. Water ingress caused by incorrect use.
  3. Open, damaged, obstructed or poorly maintained covers, seals or ports.
  4. Attempted repair.
  5. Modification.
  6. Misuse.
  7. Neglect.
  8. Corrosion.
  9. Use of unsuitable chargers or accessories.
  10. Removed or altered serial numbers.
  11. Damage inconsistent with a manufacturing fault.
  12. Evidence that the product has been opened or tampered with.

A warranty claim will not be refused simply because the product shows normal signs of careful use. However, damage, misuse or wear that caused or contributed to the fault may mean the claim is not covered.

22. Refurbished, used and clearance products

Refurbished, used, clearance or previously returned DigiFunk radios are supplied with a 1-year warranty unless a different warranty period is confirmed in writing at the time of purchase.

This warranty covers manufacturing faults or functional defects that were not disclosed at the time of sale.

It does not cover cosmetic marks, signs of previous use, packaging condition, reduced cosmetic appearance, or any fault or feature that was clearly described before purchase.

The 1-year warranty is a voluntary warranty period only. If you purchased as a consumer from DigiFunk or another trader, you may still have statutory rights after this period depending on the product’s age, price, description, condition and the circumstances of the fault.

Your statutory rights, where applicable, are not affected. When assessing whether a refurbished, used or clearance product is of satisfactory quality, factors such as price, age, description and disclosed condition may be relevant.

23. Limitations of this warranty

This warranty is limited to the repair or replacement of the product, or another remedy offered by DigiFunk under this policy.

To the fullest extent permitted by law, DigiFunk will not be responsible under this voluntary warranty for indirect losses, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of use, business interruption, or other consequential losses arising from the use of, or inability to use, the product.

This limitation applies only to remedies provided under this voluntary warranty. It does not exclude or limit any liability that cannot legally be excluded or limited, including consumer statutory rights, liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Nothing in this warranty excludes or limits liability for:

  1. Death or personal injury caused by negligence.
  2. Fraud or fraudulent misrepresentation.
  3. Liability for defective products where such liability cannot legally be excluded.
  4. Any consumer rights that cannot legally be excluded or restricted.
  5. Any other liability that cannot legally be excluded or limited under UK law.

24. Statutory rights

This warranty is a voluntary commercial warranty provided by Vortic Industries Ltd, trading as DigiFunk.

It is in addition to your statutory rights and does not replace, restrict or reduce them.

If you are a consumer, you may have legal rights under the Consumer Rights Act 2015 if goods are faulty, not as described, not of satisfactory quality, or not fit for a particular purpose made known to the seller.

Your statutory rights are usually against the retailer or seller who supplied the product to you. This may be DigiFunk if you purchased directly from us, or an authorised reseller if you purchased through another sales channel.

You may choose whether to make a claim under this warranty or pursue any statutory rights that may be available to you. Nothing in this warranty prevents you from exercising your legal rights.

25. Changes to this warranty policy

DigiFunk may update this warranty policy from time to time.

The warranty terms that apply to your product will be the terms in place at the time of purchase, unless DigiFunk later offers terms that are more favourable to you.

DigiFunk will not apply updated warranty terms retrospectively in a way that reduces the warranty protection already provided with an eligible purchase.

Promotional warranty terms may vary between promotional periods. Where a promotional warranty upgrade is offered, the terms displayed for that promotion at the time of purchase will apply to eligible orders.
